The policy I've seen applied in the past for GDB agrees with Alan.

For example, CodeSourcery has an assignment in place.  That means we
*can* assign the copyright on any given GCC patch to the FSF.  It is
not a requirement that *every* GCC patch we write be assigned to the
FSF.

If Atmel has not contributed their own work, no one else can do so on
their behalf without a legal agreement with Atmel.
