No. The packet length should also include FPU regs even if the
CPU doesn't have them.

This shouldn't be necessary. Your version of GDB should expect 90 regs:

 gdb/config/mips/tm-mips.h: 

   #ifndef NUM_REGS
   #define NUM_REGS 90
   #endif

And NUM_REGS should not be defined before this point.
