For interest, you can do all of this within an attribute in XPath 2.0:

  max(for $folder in //folder return count($folder/ancestor::folder))

although possibly the following would be slightly better (depending on
the particular pattern of optimisation in the processor):

  max(for $folder in //folder[not(folder)]
      return count($folder/ancestor::folder))
