A solution (at last).
Based on Dimitre's response:
xsl
<xsl:variable name='x' select='id("l1")'/>
<xsl:variable name='y' select="id('noteId')"/>
<xsl:template match="/">
<xsl:variable name='parentLevel'
select="$y/ancestor-or-self::*[starts-with(name(),'level')][1]/@id"/>
<xsl:message>
Here is: <xsl:value-of select="$parentLevel"/>
</xsl:message>
<xsl:choose>
<xsl:when test='$parentLevel=$x'>
<xsl:message>
Match
</xsl:message>
</xsl:when>
<xsl:otherwise>
<xsl:message>
Fail: intervening levels are:
<xsl:for-each
select='$x/descendant::*[starts-with(name(),"level")]
[not(@id=$parentLevel)]'><xsl:value-of select='name()'/>

</xsl:for-each>
</xsl:message>
</xsl:otherwise>
</xsl:choose>
</xsl:template>
I needed to add an internal DTD subset to get the id values,
which I will have anyway. But this demonstrates a solution.
Comments please?
(no, its not general purpose, but as my earlier comment indicated,
set theory and I appear to have missed each other in the night)
