Does anyone know of a fix for this problem? I'm using Cygwin 1.5.24, Rsync 2.6.9, and OpenSSH 4.5p1.

It seems that Darryl didn't have the time anymore to solve this, or he was too much worried after the whole legal discussion that followed his post that he decided not to do it at all. Which would be a pity, because I have no clue how to fix it myself.
